What Are My Rights As A Tenant?

 

Many renters do not know their rights when it comes to their property and the proper way in which a landlord can evict them from their home. There are laws governing the way in which a landlord can legally evict you from the property. You also have the right to contest eviction by consulting with a eviction attorney.

There are many different reasons that a person can become behind in their rental agreement and do to this, some individuals just sit back and wait for the eviction notice and then move. This does not always have to be the outcome.

You can sue the landlord to contest eviction or even stop eviction from rental property if the landlord is not going by the letter of the law.

In order to evict you legally, you must be served a court order by the sheriff or Marshall. If the reason for the eviction is non-payment of rent and you offer the landlord the money owed or a portion of the money owed and he/she accepts you cannot be evicted. Remember to receive a receipt with the proper date to show he accepted payment.

The landlord by law has to go to court. He cannot change the locks and force you from the home without going through the proper channels. If you have been locked out of your rental properly, you can sue the landlord to contest eviction.

The landlord does have the legal right to evict you from the property for non-payment of rent, sue you for unpaid rent, and receive a court order for the sheriff to remove you from the property.

If you have received an eviction notice and wish to stop eviction from rental property, you should contact a real estate attorney that is experienced with evictions to provide you with the best possible representation and show up in court. Tenants that fail to appear in court lose the case by default.
